Carlsbad

Carlsbad’s rules are a little different:

• Minimum operating age is 12 years old
• Mandatory helmets for all riders under 18
• NO e-bikes at Poinsettia and Pine Avenue community parks
• Reckless riding can lead to impoundment, requiring a safety course and, for young riders, parent retrieval.

Encinitas

Encinitas has a lot of great riding, but it can get crowded near downtown and beach access points like Moonlight Beach. Expect more shared-use paths and slower riding in those areas.

In Encinitas, the rules include:

• Helmets for all riders
• Minimum age of 16 for Class 3 e-bikes
• No passenger on bikes unless equipped with a permanent seat for the passenger.

Oceanside Updates e-Bike Regulations

What you need to know if you ride in Oceanside…

Why the Changes?

Local officials in Oceanside saw a sharp rise in calls for police service and resident complaints related to e-bike usage. According to city data, e–bike–related incidents rose from 69 reported calls in 2021 to more than 900 in 2025. That’s more than a 1,200% increase!

Many of these involve unsafe riding behaviors, like weaving through crowds, ignoring stop signs, or carrying passengers on bikes not designed for it.

So this week, the Oceanside City Council unanimously approved amendments to the city’s existing e-bike and mobility device ordinance. Their stated goal is to strengthen community safety while encouraging responsible riding.

Old Rules

Oceanside already had a pretty detailed bicycle and “regulated mobility device” ordinance on the books. Adopted in 2024, it covers e-bikes, scooters, skateboards, etc.

The main rules governing all riders are shown below.

Where you can’t ride

• No riding on the Municipal Pier or Pier ramps, and also not at the Oceanside Pier Amphitheater or Junior Seau Beach Community Center area.

• Restricted zone near the beach and community center: bikes and mobility devices are prohibited on certain stairways, walkways, and sidewalks within the Junior Seau Beach Community Center plaza area, including an area described as bounded on the west by The Strand.

• No riding in drainage facilities (culverts, ditches, channels, etc.) or in public athleticor sports courts or gymnasiums.

Sidewalk Operation

If you’re riding on a sidewalk, there’s a 10 mph speed limit, you must ride in the same direction as street traffic, and take extra precautions around pedestrians (including a clearance rule on narrow sidewalks).

“Rules of the road”

• Obey all traffic laws and ride at a safe speed (not exceeding posted limits), slowing in high-pedestrian areas.

• Helmets are required for riders 17 and under.

• Don’t endanger pedestrians or others and keep a safe distance, especially on trails.

Trails

On city trails less than 5 feet wide, riders must dismount when pedestrians or equines are within 50 feet.

Passengers / Unsafe behavior (baseline rules)

The 2024 ordinance prohibits carrying passengers on non-designated parts of the device and attaching the device to moving objects.

New Regulations

The following regulations are NEW and were added to Oceanside’s existing laws.

1. Police Can Now Seize Bikes

Under the updated ordinance, Oceanside police are now authorized to temporarily confiscate an e-bike if a rider:

• Is cited for reckless operation or a failure to observe safety laws;

• Commits two or more violations within 12 months.

The seizure is temporary, and the bike can be returned once the case is resolved, often through participation in an approved safety course rather than fines or court costs.

The goal isn’t punishment, but deterrence: giving riders a real reason to pay attention to safety and avoid repeat unsafe behavior.

2. No More “Double Riding”

Another important change is a ban on carrying passengers on e-bikes that aren’t designed with a passenger seat. Whether you’re riding along the boardwalk or through neighborhoods, only bikes built for two people are legally allowed to carry an extra rider.

This rule aligns local code with California Vehicle Code standards and is intended to reduce loss-of-control incidents that can happen when bikes are overloaded or not designed for extra weight.

3. Education First — But With Teeth

Oceanside already had an “education first” policy, and while the new measures add enforcement tools, the city still emphasizes education:

✔ Riders may attend free bicycle and e-bike safety classes offered by the Oceanside Police Department as a way to resolve minor citations.

✔ Seized e-bikes will be returned once safety requirements are completed, and owners will not be charged extra storage or impound fees.

Oceanside wants to encourage responsible riding habits without overly penalizing riders, especially younger riders who might be less familiar with the rules of the road.
